Terms & Conditions
Retainer & Payment
To reserve your event date, a 25% non-refundable (for Portfolio-Building offer) retainer along with travel fees (applies only outside Perth, WA) and a signed contract are required. This retainer secures the artist's availability, as other work will be turned down for your date. However, it will be applied toward your total package cost.
If the client cancels at least 7 days before the event, the retainer can be used as credit towards another artwork by The Live Wedding Artist. The remaining balance must be paid in full 1 week before the event.
Changes to Date or Venue
Any changes to the event date or location must be communicated at least 1 week in advance by phone and email. The client is responsible for confirming all details 7-10 days before the event.
Copyright Information
All paintings created by The Live Wedding Artist are protected under copyright law and cannot be copied, altered, or reproduced in any way. If posted on social media, credit must be given to The Live Wedding Artist either in the caption or within the image itself.
Cancellation & Refund Policy

The retainer is non-refundable after 48 hours of signing the contract.

If the event is cancelled within 1 month of the event date, the full balance is due since it is unlikely the artist will be able to rebook the date.

If cancelled at least 7 days before the event, the retainer can be used as credit toward another artwork.

Cancellations must be made in writing even if a phone call has been made.
Painting Quality & Setup

The painting will be created in a realistic style on a gallery-wrapped canvas with professional acrylic and oil paints and sealed with varnish.

A designated space (at least 1.2m x 1.8m) with a clear view of the scene - if applicable, an electrical outlet, and access to a nearby sink must be provided.

The artist will arrive 1-2 hours before the event to set up and begin painting the background. The client must notify the venue of the artist's early arrival.
Responsibilities & Limitations

The Live Wedding Artist is not responsible for incomplete paintings due to weather, venue restrictions, schedule conflicts, or late arrivals of key subjects.

The client is responsible for securing all necessary permits and covering any location fees.
Force Majeure (Unforeseen Circumstances)
If The Live Wedding Artist is unable to perform due to extreme circumstances (e.g., severe weather, illness, travel disruptions, or unforeseen emergencies), The Artist shall return any monies paid by the client, less expenses, but shall have no further liability with respect to the agreement. This limitation of liability shall also apply in the event that painting is damaged in processing, lost in the mail, or otherwise lost or damaged without the fault on the part of The Live Wedding Artist..
Travel & Meals

The client and The Live Wedding Artist assume the risks of travel. If an unavoidable last-minute travel issue occurs, all monies paid (except the retainer) will be refunded. Travel Fees apply outside Perth if more than 50km from my location. e.g. 70km from the artist location. 20km will be charged by $1.40/km (roundtrip).

If the event lasts 6 or more hours, a meal for the artist would be required and greatly appreciated.
Use of Painting for Promotion
The Live Wedding Artist has the right to use images of the painting for advertising, portfolio, or promotional purposes.
Delivery
The completed painting will be delivered within 14-18 weeks after the event. Please note that this timeframe may vary depending on factors such as drying times and any additional enhancements requested by the client may extend this timeline. In the event of unforeseen delays, the Client will be notified promptly, and a revised delivery estimate will be provided. Shipping costs outside Perth, WA, are covered by the client.
Entire Agreement
This contract represents the entire agreement between the client and The Live Wedding Artist. Any changes must be in writing and signed by both parties.
Artistic Interpretation
The Client understands and agrees that the painting is based on the Artist’s interpretation of the event and reference materials provided. The Artist retains full creative freedom regarding composition, style, colour, and artistic expression. While the Artist will make reasonable efforts to capture key likenesses and details, the final artwork reflects the Artist’s personal vision and artistic style.
The client is responsible for reaching out 4-6 weeks before the event to review final details. The Live Wedding Artist will make every effort to contact the client, but it remains the client's responsibility to confirm event details and times.
